Terms of Service 

Effective Date: 1 January 2026

These Terms of Service (“Terms”) govern your access to and use of hozenguitars.com (the “Site”) and any purchases made directly from Hozen Guitars (“Hozen Guitars”, “we”, “us”, “our”). By using the Site, creating an account, submitting an inquiry, or purchasing from us, you agree to these Terms.

If you do not agree, do not use the Site.


1) About Hozen Guitars

Hozen Guitars produces instruments in very limited quantities. Our guitars are handcrafted and personally voiced; natural variation in wood, finish, and tone is inherent to boutique instruments.


2) Eligibility

You must be at least the age of majority in your jurisdiction to use the Site or purchase from us. By using the Site, you represent that you are legally able to enter into a binding contract with us.


3) Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted on the Site. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.


4) Privacy

Our collection and use of personal data is governed by our Privacy Policy (to be linked on the Site). By using the Site, you consent to our processing of your data in accordance with the Privacy Policy.


5) Products, Listings, and Availability

  1. Product descriptions: We aim to describe products accurately, but photos, videos, and written descriptions are for general reference.

  2. Natural variation: Wood grain, color, figure, texture, and tonal response may vary from guitar to guitar and may appear differently in photos due to lighting, cameras, and screens. These are not defects.

  3. Limited availability: Inventory is limited and may change without notice.


6) Pricing and Currency

  1. All prices are shown in the currency indicated on the Site (or on your invoice).

  2. Prices may change at any time without notice.

  3. Taxes, import duties, VAT/GST, brokerage fees, and customs charges are not included unless explicitly stated in writing.


7) Orders, Payment, and Acceptance

  1. Order submission: An order is an offer to purchase. We may accept or decline any order at our discretion (including due to suspected fraud, export restrictions, or inventory limitations).

  2. Payment: You agree to provide accurate payment and billing information and authorize us (or our payment processor) to charge the total amount due.

  3. Payment processing: Payments may be handled by third-party processors. We are not responsible for processor outages or errors.

  4. Cancellations: If a cancellation is permitted, it must be approved by us in writing. Any approved cancellation may be subject to non-refundable payment processing fees and/or work already completed.


8) Shipping, Delivery, Risk of Loss

  1. International shipping: Most of our clients are overseas. Shipping times are estimates and may be affected by customs clearance, carrier delays, weather, or other events outside our control.

  2. Risk of loss: Risk of loss transfers to you once the shipment is handed to the carrier (unless your local consumer law requires otherwise).

  3. Third-party carriers: Shipping is performed by third-party carriers/forwarders. We may assist with arrangements, but transit outcomes and customs decisions are outside our control.

  4. Inspection: You must inspect shipments promptly. Our Arrival Inspection Window is described in our Return/Service policies.


9) Duties, Taxes, Customs, and Compliance

  1. Customer responsibility: You are responsible for any import duties, VAT/GST, customs fees, brokerage fees, or other governmental charges imposed by your country.

  2. Export/import regulations: International shipments may be subject to export/import laws and restrictions, including rules regarding regulated materials and protected species.

  3. Permits/documentation: Where applicable, we will provide standard documentation we reasonably have or can obtain, but approval, clearance, and local requirements remain your responsibility.

  4. Refusal/return by customs: If a shipment is refused, returned, seized, or delayed due to customs or regulatory issues, you remain responsible for related costs.


10) Returns, Exchanges, and Service Shipping

Purchases made directly from Hozen Guitars are governed by our separate policies:

  • Warranty Policy (to be linked)

These policies are incorporated into these Terms by reference.

Key principle (summary): For international returns/exchanges/service shipments, customers are responsible for all shipping and taxes (both ways) unless the guitar is delivered/collected in person at our workshop by appointment (as stated in the relevant policy).


11) Warranty

Warranty coverage, exclusions, and procedures are defined in our Warranty Policy (to be linked). Normal wear, humidity/temperature-related issues, accidental damage, and misuse are generally not manufacturing defects.


12) Care, Humidity, and Use

Acoustic instruments are sensitive to humidity and temperature swings. You are responsible for:

  • proper humidity control and storage,

  • avoiding extreme temperature/humidity exposure,

  • following reasonable care instructions provided with the instrument.

Failure to care for the instrument properly may affect warranty coverage.


13) Intellectual Property

All content on the Site—including text, images, videos, logos, designs, and product names—are owned by or licensed to Hozen Guitars and protected by intellectual property laws. You may not copy, reproduce, distribute, modify, or exploit Site content without our written permission.


14) User Content (Reviews, Comments, Submissions)

If you submit content (e.g., reviews, photos, videos, testimonials, messages, or recordings):

  1. You represent you own or control the rights to that content.

  2. You grant Hozen Guitars a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and publish it for marketing, product education, and community purposes (unless you explicitly request otherwise in writing).

  3. We may remove content at our discretion.


15) Prohibited Use

You agree not to:

  • misuse the Site, attempt unauthorized access, or disrupt services,

  • transmit malware or malicious code,

  • engage in fraudulent transactions or chargeback abuse,

  • violate any applicable laws or third-party rights,

  • scrape, copy, or harvest content or data without permission.


16) Third-Party Links and Services

The Site may contain links to third-party sites or tools (e.g., payment processors, shipping services, social media, YouTube). We are not responsible for third-party content, policies, or practices.


17) Disclaimers

  1. Site provided “as is”: The Site and its content are provided on an “as is” and “as available” basis.

  2. No guarantee of tone preference: Tone is subjective and influenced by player technique, setup, environment, humidity, strings, and other factors. We do not guarantee that an instrument will match any particular tonal expectation.

  3. Technical content: Any setup/care guidance is general information and not a substitute for professional assessment of local conditions.

Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.


18) Limitation of Liability

To the maximum extent permitted by law, Hozen Guitars will not be liable for indirect, incidental, special, consequential, or punitive damages (including loss of use, profits, or goodwill). Our total liability for any claim relating to the Site or any purchase will not exceed the amount you paid for the product giving rise to the claim.

Some jurisdictions do not allow limitations of liability; in that case, liability will be limited to the maximum extent permitted by law.


19) Indemnity

You agree to indemnify and hold harmless Hozen Guitars from claims, damages, liabilities, costs, and expenses arising from your misuse of the Site, your breach of these Terms, or your violation of any law or third-party rights.


20) Governing Law and Disputes

These Terms are governed by the laws of Singapore, without regard to conflict of law principles.

Any dispute shall first be attempted to be resolved informally by contacting us. If unresolved, disputes shall be submitted to the courts of Singapore, unless mandatory consumer protection laws in your jurisdiction require otherwise.


21) Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.


22) Entire Agreement

These Terms, together with our Privacy Policy, Warranty Policy, and Return/Exchange/Service policy (each as linked on the Site), form the entire agreement between you and Hozen Guitars regarding the Site and purchases.
